At ActivMinds (referred to as “ActivMinds“, “we“, “us“, and “our“), we are committed to protecting the privacy of our users. If you are in South Africa, we are the data controller, unless otherwise stated. Please read the following privacy notice that explains how we collect, manage, and protect your personal data.

This is the Privacy Notice (“Notice“) for the EDUactiv app, and all related services (“Services“).

What Information Do We Collect & How Do We Use It?

This Notice will apply to you if:

  • You visit and browse the EDUactiv app or website.
  • You are a parent or individual user looking for extracurricular activities for your children (“User“).
  • You are a business, coach, or teacher looking to list your extracurricular services for children (“Partner“).

 

We will only use the information we collect about you if there is a reason for doing so, and if that reason is permitted under data protection law. We explain the usual reasons for collecting your data in each section below, and we clarify what these legal reasons mean under ‘What do each of these legal reasons mean?’

Information Collection

For Users: We collect your cell number, name, surname, and password when you sign up to use the app.
For Partners: We collect your name, surname, mobile number, password, business email, business name, the nature of your service (remote or on-site), business address (if on-site), and your service area (if remote).


Use of Your Information

The information we collect is used to help you sign up and use the EDUactiv platform. We may also use it for customer support, service improvements, and to notify you about updates relevant to your profile and your activities.

If You Visit Our Services

We use your information to provide you with our Services. If you visit any of our Services, whether you’re just browsing or you have a profile, we will automatically collect information from you each time you use our EDUactiv app or website. This includes technical information, information about your visit, and (if you opt-in) location data:

 

Technical Information

Technical information may include your phone number, login information, hardware version, device settings (e.g., language and time zone), file & software names and types (associated with your device and/or the Services), battery & signal strength, information relating to your mobile operator or Internet Service Provider (ISP).

 

Information About Your Visit

Information about your visit may include the full Uniform Resource Locators (URL), clickstream to, through, and from our Services (including date and time), pages and services you viewed or searched for, demographic information (such as age and gender), page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), traceable campaign links (e.g., in emails, or via tracking URLs), methods used to browse away from the page, and any phone number used to call our customer support or social media handles used to connect with our customer service team and social media accounts.

 

Location Data

Location data includes your country location (based on your full or partial IP address and/or analytics data) which we use to provide location-based services (if you ask or permit us to), so that we can deliver content or other services that depend on knowing where you are. For example, this helps us improve your experience by delivering more relevant local content or services.

Location data may be collected in combination with device ID, so we can recognize your mobile device when you return to the Service.

Delivery of location services will involve us checking any of the following:

  • the coordinates (latitude/longitude) of your location,
  • your current country or region, based on your current IP address, and/or
  • your mobile device ID (if available).

You can opt-in and out of location sharing by changing your device settings.

We Use This Automatically Collected Information To:

  • Understand how individuals use our EDUactiv app and website, and how we can improve it.
  • Ensure content from our Services is presented in the most effective manner for you and for your devices.
  • Provide you with the information, services, and activities that you request from us or that we think may interest you.

Automated Decision-Making

We may use ‘profiling’ or automated decision-making tools in processing personal data that we automatically collect about you. We may use this personal data to provide you with personalized notifications, such as updates on new activities, services, or events. These notifications may be delivered via email, SMS, social media advertisements, or other digital channels, all related to the Services offered by EDUactiv.

If You Contact or Engage with Us

If you contact or engage with us, we will collect your contact information and any other communications information you provide.

Contact Information includes basic contact details you provide, such as:

  • Email address,
  • First and last name,
  • Phone number(s),
  • Social media handle (for example, if you engage with us on social media).

 

Communications Information includes any correspondence you have with us. For example, if you get in touch with our Customer Support team about an issue with the EDUactiv app or to report a problem, this may include:

  • Emails,
  • Texts, in-app messaging, and other digital messaging,
  • Calls,
  • Letters,
  • Any in-person conversations you have with us.

 

We Use This Contact and Communications Information To:

  • Contact you if you have asked us to, including responding to your queries, troubleshooting problems, and helping with any issues you may have with our Services.
  • Provide you with information you might request about our Services.
  • Put you in touch with Partners (coaches, teachers, or businesses) you ask us to share your information with.
  • Provide you with technical and other service updates (for example, if we update our Terms of Use or Privacy Notice).

If You Use Our Services

When you create a profile on EDUactiv, we may collect the following information:

  • First and last name,
  • Email address,
  • Mobile phone number(s),
  • Any other information you provide, such as your profile photo (optional).
    We assign unique user IDs or other profile-level IDs to your EDUactiv profile.

As you use your profile, we may collect information about:

  • Your activity, such as which extracurricular activities you view or express interest in,
  • Your profile settings and preferences,
  • Any user-generated content you provide, such as reviews or comments,
  • Details in accordance with our Cookie Notice.

 

We Use This Information to Manage Your Profile with Us, Including:

  • Maintaining your EDUactiv profile,
  • Providing customer support,
  • Enabling you to contact and interact with our Partners (coaches, teachers, or businesses),
  • Providing you with a personalized experience, including recommending services, activities, and Partners, we think you may be interested in.

If We Send You Offers, Updates, or Other Marketing Material

We may collect your contact information (as explained above), such as your name and email address.

We may also collect marketing preferences, which are our records of what information you would or would not like to receive from us, and whether you have opted out of any direct marketing.

We Use This Contact and Marketing Preference Information To:

  • Send you offers, updates, promotions, newsletters, and other marketing material.
  • Provide personalized marketing, including offers, features, services, and Partners, we think you may be interested in.
  • Work with digital advertising partners to deliver relevant promotions.
  • Contact you to ask for feedback, including through surveys and other marketing research.
  • Provide details in accordance with our Cookie Notice.

 

Opting Out
You can opt out of receiving further marketing at any time by selecting the “unsubscribe” link at the end of our promotional updates or by adjusting your communication preferences in the app.

What Do Each of These Legal Reasons Mean?

We must have a relevant legal justification, called a ‘lawful basis,’ for each way in which we use your personal data. These lawful bases may include consent, a contract with you, compliance with legal obligations, and legitimate interests.

Fulfilling Agreements with Partners

Complying with or supporting any agreements EDUactiv has with businesses listed on our platform. For example, ensuring their services are accurately represented and accessible to users.

Who Do We Share Your Information With?

If You Are a User
We do not share your personal information with our Partners. Instead, EDUactiv allows you to view Partner details directly on the platform so you can contact them at your discretion.

If you leave a public review for a Partner on EDUactiv, your review, rating, review date, and first name and last initial will be visible to other users on our platform. These reviews remain visible even if you stop using the platform, as they are intended to help other users make informed decisions.

 

If You Are a Partner
Users can leave reviews about your services on EDUactiv. These reviews, along with any ratings, will be publicly visible on the platform, helping you showcase your offerings to other users.

We may also promote Partner information, such as reviews and ratings, on other platforms or through advertising efforts to enhance your visibility to a wider audience.

 

If EDUactiv Processes Your Information as a User or Partner

We may share your information with the following entities, but only to the extent necessary to provide, improve, or safeguard our services:

  • Service Providers: Organizations that process your personal data on our behalf and in accordance with our instructions under data protection laws.
    These include providers supporting services like website hosting, data storage, IT support, app functionality, distributing communications (e.g., newsletters or updates), and collecting feedback about our platform.
  • Auditors and Legal Advisors: Professional advisors, such as auditors or legal teams, may require access to your information to fulfill legal or compliance obligations.
  • Legal or Regulatory Requirements:

What EDUactiv Does Not Do

  • We do not share user information with partners listed on the platform. Users can view Partner details directly and decide whether to contact them.
  • We do not share your personal data with other third parties for unrelated activities like prize draws or third-party promotional campaigns.

Where Do We Store Your Information?

EDUactiv operates solely within South Africa. Your personal information is stored securely within our servers located in South Africa and managed under strict data protection measures.

We do not transfer your personal data outside of South Africa.

How Do We Protect Your Information?

Data collected by EDUactiv is stored in secured databases with strict access controls. Access to this data is limited to authorized personnel only.

While we strive to ensure the security of your information, it is important to note that no method of transmission over the internet is completely secure. We cannot guarantee the security of data during transmission, and any transmission is done at your own risk. Once your data is received, we use robust security procedures and systems to safeguard against unauthorized access.

Payment Processing

EDUactiv does not handle any payment processing directly on the app. All payments must be arranged directly with the partner businesses. When making a payment, users will interact with the respective business or service provider for details on how to complete their transaction.

Since we do not process payments, we do not store or have access to any payment details, including credit card or other payment methods. Any financial transactions or payment processing are solely managed by the partner business, and all related data is subject to their privacy policies and terms.

External Sites

EDUactiv may contain links to external sites, such as a coach’s or business’s website. If you choose to follow any of these links, please note that these websites have their own privacy policies. EDUactiv does not accept any responsibility or liability for the privacy policies or content of external sites and does not necessarily endorse the views expressed within them. We have no control over the availability of these websites.

Please ensure you review each site’s privacy policy before submitting any personal information to external websites.

How Long Is Your Information Kept For?

We will generally process personal information:

  • For as long as it is necessary for the purpose(s) for which it was originally collected (for example, to manage your profile or support your interactions with partners on the platform).
  • We may retain your personal data for up to six years after that, to resolve any issues or potential legal proceedings.
  • In some cases, we may keep data for a longer period if there are ongoing complaints or legal matters, or if applicable law requires us to retain it.

If you have opted to receive insights, newsletters, or other promotional material, but later decide to opt out from receiving these updates or object to any other processing of your personal information, we may keep a record of your opt-out or objection to respect your preferences.

We may also retain aggregated, anonymised, or pseudonymized data (e.g., for reporting or analytics purposes) for longer periods.

What Rights Do You Have With Your Personal Information?

In certain circumstances, you have the following rights:
